SMDigital Partners LLC (“SMDigital,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, sell, and share personal information in connection with smdigitalpartners.com and our related websites, applications, products, and services (the “Platform”), and the rights and choices you have. For California residents, the California-specific rights below describe additional rights under the CCPA, as amended by the CPRA.

1. Information We Collect

We collect the following categories of personal information, depending on how you interact with us:

We do not collect categories beyond those listed without updating this policy. Personal information does not include publicly available government records or deidentified or aggregated information.

2. Sources of Information

We collect information directly from you (when you contact us, request services, create an account, fill out a form, or participate in a survey or promotion); automatically as you use the Platform (via cookies and similar technologies, subject to the consent mechanism in Section 9); from social sign-on if you choose to use it; and from third parties such as analytics providers, advertising networks, and publicly available sources.

3. How We Use Information

We use personal information to: provide and operate the Platform and our services; register and service accounts; process and fulfill orders and payments; communicate with you and provide customer service; run sweepstakes, contests, surveys, and events; measure and analyze marketing performance; deliver, personalize, and measure advertising, including retargeting; protect against fraud and secure our systems; and comply with legal obligations. We may also record telephone calls with us for quality, training, and record-keeping purposes; where we do, we provide notice at the start of the call.

4. Sensitive Personal Information

Where we collect information that qualifies as “sensitive personal information” under the CCPA — such as payment account information or account log-in credentials you provide — we use it only for the purposes permitted under the CCPA, such as providing the services you request and securing your account. We do not use or disclose sensitive personal information to infer characteristics about you. California residents may exercise the right to limit described in Section 7.

5. How We Disclose, Sell, and Share Information

We disclose personal information to: service providers and contractors (hosting, analytics, payment processing, customer communications, security); advertising and analytics partners, including in connection with the cookies and technologies in Section 9; affiliates; parties to a merger or acquisition (you will be notified); and legal or safety recipients where required by law or to protect rights and safety.

Selling and sharing. We use advertising, retargeting, and audience-matching technologies (for example, Facebook Custom Audiences and Google Customer Match) and work with advertising partners and data-management platforms. These activities may constitute the “sale” or “sharing” (cross-context behavioral advertising) of identifiers and internet-activity information under the CCPA, even where no information that directly identifies you by name is disclosed. California residents have the right to opt out — see Sections 7 and 8. We do not knowingly sell or share the personal information of consumers under 16 without affirmative authorization, and we do not sell or share sensitive personal information.

6. Retention

We retain each category of personal information only as long as reasonably necessary for the purposes described here, including to provide services, maintain records (for example, financial and transaction data retained for up to seven years for tax purposes), and meet legal obligations, after which we delete or deidentify it. Retention is determined by the nature and sensitivity of the data, the purposes of processing, and applicable legal requirements.

7. Your Privacy Rights

Depending on your jurisdiction and subject to verification and legal exceptions, you may have the right to:

  • Know / Access the categories and specific pieces of personal information we have collected, the sources, purposes, and recipients.
  • Delete personal information we collected from you.
  • Correct inaccurate personal information.
  • Opt out of Sale/Sharing of your personal information for cross-context behavioral advertising.
  • Limit the use of Sensitive Personal Information to permitted purposes.
  • Data portability — receive your information in a portable format.
  • Non-discrimination for exercising your rights.

We will verify your identity against information in our records before responding, and will respond within the timeframes required by law (generally 45 days, extendable to 90). An authorized agent may submit a request with proof of authorization. We honor the Global Privacy Control (GPC) as a valid opt-out-of-sale/sharing signal for the browser or device on which it is enabled.

9. Cookies and Tracking Technologies

The Platform uses cookies and similar technologies (pixels, tags, local storage, SDKs) for functionality, security, analytics, advertising and retargeting, and embedded features. We manage these through a consent management platform (Cookiebot by Usercentrics), organized into categories:

  • Strictly necessary (always active): core functionality, security, and form handling.
  • Analytics & performance (consent required).
  • Advertising & marketing (consent required), including retargeting and audience-matching tools.
  • Session/Functionality (consent required), including any session-analysis or embedded third-party features.

Except for strictly-necessary cookies, these technologies activate only after you consent through the banner presented when you arrive. You may accept, decline, or customize categories, and change your choice anytime via the “Cookie Settings” link in the footer. We also honor the Global Privacy Control signal as described above.

10. Children’s Privacy

The Platform is not directed to children under 13, and we do not knowingly collect their information. You must be 18 to purchase services. We do not knowingly sell or share the personal information of consumers under 16 without the affirmative authorization required by law.

11. Other U.S. State Privacy Rights

Residents of other states with comprehensive privacy laws may have similar rights to access, correct, delete, and opt out of targeted advertising or the sale of personal information. To exercise them, use the methods in Section 8.

12. Visitors Outside the United States

SMDigital is based in, and operates from, the United States. We do not target or direct our Platform or services to individuals in the European Union/EEA, the United Kingdom, or other regions outside the United States, and we do not have clients or operations there. The Platform is accessible globally; if you choose to access it from outside the United States, you do so on your own initiative, and your information will be collected, transferred to, stored, and processed in the United States under U.S. law, which may not provide the same protections as the laws of your jurisdiction.

13. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit for sensitive submissions. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

14. Third-Party Links

The Platform may link to third-party sites we do not control. This policy does not apply to them; please review their privacy policies.

15. Changes to This Policy

We may update this policy from time to time. We will post the updated version here with a revised “Last Updated” date and, where appropriate, provide additional notice.
